you cannot pass smog with a check engine light on.. at least in california you cant.

Check whether the VSS gets battery voltage and whether the ground wire has continuity to body ground. If those are fine, check the wire running between the VSS and ECU for an open or short. The VSS connector also seems to be a common problem.

definitely doublecheck the 3 sockets inside the connector on the VSS wire, as well as all 3 pins on the vss. I've seen them corrode out multiple times.
If the connector on the wire end is corroded, just snag any similar square 3 prong honda connector from the junkyard and solder it on. That's what I did... think mine came off an old Accord. It doesn't have to be a VSS connector, just one the same shape.
