First, conducting open trials in federal courts means that some of the very best evidence will be withheld from use by the government's prosecutors out of concern that use of such evidence will compromise national security in the future. <br />
<br />
Second, enemy combatants have never been entitled to the rights of a suspect about to undergo interrogation in police custody. For that reason, they have never been entitled to be warned of those rights before questioning. As most Americans know, failure to warn a suspect of their Miranda Rights risks the ability to use any information obtained from interrogations. This introduces the possibility that much of the subsequent investigation and evidence obtained following such questioning will not be allowed in a criminal court. The result: far fewer tools for prosecuting the very worst terrorists. <br />
<br />
Third, allowing terrorists their day in criminal court gives them a broad platform from which to spew hatred and draw others to their cause. There is no need to move these trials away from the relatively private and extremely secure military commission setting. In fact, in this particular situation, it is estimated that it will cost local law enforcement authorities roughly $75 million to provide security for these proceedings. <br />
<br />
The bottom line is that there is no rational justification for these terrorists gaining access to domestic courts. The decision jeopardizes not only the chances of a vigorous prosecution, but also the security interests of our nation in general, and New York City specifically. <br />
<br />
Fortunately, Sen. Lindsey Graham (R-SC) will try to stop this transfer from occurring. He is introducing legislation in the United States Senate that will prohibit the trials be moved out of the military commissions. ACLJ will be working vigorously to assist Sen. Graham in this effort.</div>

				We often forget that the power wielded by government exists only because there are those willing to carry out its orders. The &quot;Government&quot; is not an Artificial Intelligence that exists in a science fiction movie. Rather it comprises real people who have the choice to either follow or refuse an order. In wake of the 1832 Supreme Court case, Worcester v. Georgia, presided over by Chief Justice John Marshall, President Andrew Jackson is famously rumored to have stated, &quot;John Marshall has made his decision, now let him enforce it.&quot; Knowing the Supreme Court had no army, police or agents to enforce their decisions, the implication was clear.<br />
<br />
A law passed by Congress, signed by the President, and upheld by the courts will never be carried out or enforced unless there are men with badges and with guns willing to comply. It is important we remember this when we reflect on laws that are passed, directives that are issued and agencies that infringe on our civil liberties. Just one such example of such an agency is the Transportation Security Administration or TSA.<br />
<br />
Campaign for Liberty regularly holds conferences and events to energize our members and educate those new to the ideals of liberty. From the sale of tickets, books, t-shirts, and generous donations, a weekend of excitement often finds Campaign for Liberty with money to transport back to headquarters. In my responsibilities as Director of Development I often find myself tasked with carrying this money. On one occasion, things got interesting.<br />
<br />
As I always do when transporting money from Campaign for Liberty events, I place the funds in a thin metal cash box similar to that found at a raffle or church bazaar, with the box then placed in my carry-on bag. After working my way through the numerous levels of checkpoints, I finally came to the baggage screening. I handed my ticket and my license to the initial TSA agent and proceeded to the screening. After I had walked through the metal detector and handed my ticket to the attendant for further verification, I waited for my items to come out of the machine. The screening attendant motioned for assistance and an additional TSA attendant soon came over.<br />
<br />
This individual ordered me off to the side and proceeded to search through my bag. As he looked through my belongings, he eventually took out the moneybox and informed me he needed to look through it. I asked him if I was being detained or if I was free to go. Upon his second demand to search it, I asked if the box was being detained. Never did he provide a direct answer to my question, and likewise never did I offer my consent to a search.<br />
<br />
He began to grow hostile and told me he was sick of the back and forth. He ordered me into a side room next to the security checkpoint. Not wanting to inform Congressman Ron Paul and Campaign for Liberty members I had lost their generous donations, I followed him. As I was being led into this room off the concourse, I thought of situations that often begin this way and far too often do not end well for the lone individual questioning the government’s presumed authority. As the agent settled in I quickly took out my mobile phone, highlighted the proper setting, slipped the phone upright in my front jacket pocket, and began recording the conversation. <br />
It has often been said that, &quot;The Camera is the New Gun.&quot; Such words ring true. In an age where agents of the government create more regulations and wield more power, it can often seem hopeless for individuals to do anything to challenge an authority that does not follow its own laws. However, a simple video camera or audio recorder can often have a far-reaching effect. In this case, it changed the policy of the federal government. Some important things to remember when dealing with anyone in law enforcement:<br />
<br />
• Be Prepared<br />
<br />
Some have asked me if I planned the situation, wanting to be caught and wanting to cause a scene. In reality I was tired from the weekend, trying to respond to old emails via my cell phone, and gritting my teeth as I had another few hours of air travel ahead of me. The last thing on my mind was a desire to argue with the government. However, carrying a pocket Constitution and having the presence of mind to record a conversation are things everyone can do. Without question the inquiry most often made is, &quot;What program did you use to record that?&quot; The application was called &quot;iTalk&quot; and is a free application you can download to your iPhone. Determine if your mobile phone can record audio and if possible video. If it cannot, download or buy the software. The tool it will provide against government abuse will be worth it.<br />
<br />
• Know the Law<br />
<br />
While I do not have a tremendous knowledge of the law, in my interaction with TSA and subsequently the St. Louis police, I was aware of what I had to say and more importantly what I did not have to say. I knew full well that I did not have to tell the TSA where I worked, and despite the TSA’s lies or ignorance of the law themselves, I also knew I did not have to tell the police either. Don't just talk about Constitutional liberties and what they mean. Study them and incorporate that knowledge into interactions in your daily life.<br />
<br />
• Keep Your Cool<br />
<br />
Despite the TSA’s and police department's claim that I was &quot;being difficult&quot; or &quot;acting like a child,&quot; only one of us ever raised his voice, used offensive language, or threatened physical action. One slip up and the government’s whole story changes. Now the TSA is justified because you swore at them, called them names, or insulted their job. Don’t give them the slightest opportunity. In any interaction with any type of law enforcement, remain calm and respectful. You may find out that the officer knows the law also, and will let you leave. If not, you'll be taking the high road (and hopefully remembering to record the conversation).<br />
<br />
With the recording now going, I entered the room and watched the TSA agent sit down and begin filling out paperwork. He asked me what I did for a living and in return I asked him if that was relevant. Upon being told it was, I asked if I was legally required to answer. He was not pleased and amidst a fury of expletives stated that while I was not required to tell him, I would be required to tell a police officer. (I knew full well I wasn't, though decided not to tempt the situation.)<br />
<br />
What then occurred was a 30-minute interrogation at which any given time a half dozen individuals were crowded in the small office. At first a police officer entered and informed me that I did indeed have to tell the TSA where I worked. Upon my asking for clarification he backed off his initial statement. When a second police officer entered, the interrogation continued. Amid threats of involvement with the FBI and DEA, I saw firsthand the strong-arm tactics that unfortunately some in law enforcement use. The questioning went back and forth between myself, TSA, police officers, and random individuals entering and leaving. Consistently I kept my responses simple, yet polite, and asked questions in return. &quot;Am I legally required to answer that?... Does the law state I have to tell you that information?... Can you please tell me what my rights are concerning that inquiry?...&quot; As I continued, I was either yelled at or accused of refusing to comply.<br />
<br />
At one point I was informed, &quot;If you have nothing to hide, just answer the question.&quot; I cringed as I listened to the argument used by those who give preeminence to the state over the individual. This line of training had apparently been bred into in these agents and was unfortunately well engrained in whatever type of training they had received.<br />
<br />
Though it is easy to look back on the situation and claim that it was under control the whole time, I was still in a situation I would have preferred to avoid. I was in a small, enclosed room with no windows and a locked door. A half dozen government agents, some of them carrying loaded firearms, surrounded me. And I was cursed at, berated, and threatened with arrest. Anything can happen in that situation. Someone slips, someone falls, someone gets nervous, and suddenly you're in a situation where you not only risk the word of six people against yourself, you risk possible physical harm.<br />
<br />
After a half hour of back and forth, these &quot;authorities&quot; informed me I would be taken down to the station and asked me if I needed to be handcuffed, to which I politely declined. Upon my further statement that I was looking for guidance and did not fully understand the law, I was told, &quot;We’re gonna help you understand the law.&quot; One can only wonder what they meant by that. Thankfully I did not need to find out. I was actually led out of the interrogation room and about 10 yards down the concourse, a plain-clothes official stopped the parade of government employees. He called them back and upon looking at the money stated matter of factly that they were contributions to &quot;Campaign for Liberty.&quot; (The fact there were numerous checks that were actually written out to &quot;Campaign for Liberty&quot; was apparently missed by the half dozen officers taking parting in the interrogation.) After one of the police officers asked for my contact information and phone number in order to follow up (I graciously declined to give it to him), I was on my way within a matter of minutes.<br />
<br />
Upon my return home I began to speak with individuals well versed in legal matters and decided to push forward against the government abuse that had taken place. Judge Andrew Napolitano featured a piece on his show, &quot;Freedom Watch&quot; and I spoke with legal experts on both the left and the right. I determined the American Civil Liberties Union was the most professional in this matter as they shared my goal to push for principle and a change in policy over financial compensation. The suit was filed in response to the violation of my Constitutional rights and soon Bierfeldt v. Napolitano, a suit against the Department of Homeland Security and its Secretary Janet Napolitano (no relation to the judge), was underway.<br />
<br />
Curiously, only a week before the government's response was required, the TSA stated they would be altering their policy for flight security. Their screening process would be limited to searches for the purpose of safety only and their illegal searches and detainments of the past could not continue. With this change in policy the ACLU voluntarily dismissed the suit, pending TSA's compliance. No longer can the TSA harass passengers for carrying cash. Suspiciousness searches unrelated to airline safety should be a thing of the past. With an adherence to the Constitution, the latest technology, and a tremendous amount of support from Campaign for Liberty members and liberty advocates all throughout the country, we had been able to influence a direct change in federal policy. We had fought the law, and we had won.

Personnally, I'd LOVE to see her run.  The mockery it would make of our democratic process would be well worth the nearly endless laughs it would provide.  It would also guarantee Obama the win.  As imperfect as he is, I'll take him over anything the GOP will end up offering.</div>

Leaders of one of the world's most effective jihadist organizations, the Libyan Islamic Fighting Group (LIFG), have written a new &quot;code&quot; for jihad. The LIFG says it now views the armed struggle it waged against Col. Moammar Gadhafi's regime for two decades as illegal under Islamic law.<br />
<br />
The new code, a 417-page religious document entitled &quot;Corrective Studies&quot; is the result of more than two years of intense and secret talks between the leaders of the LIFG and Libyan security officials.<br />
<br />
The code's most direct challenge to al Qaeda is this: &quot;Jihad has ethics and morals because it is for God. That means it is forbidden to kill women, children, elderly people, priests, messengers, traders and the like. Betrayal is prohibited and it is vital to keep promises and treat prisoners of war in a good way. Standing by those ethics is what distinguishes Muslims' jihad from the wars of other nations.&quot;<br />

The code has been circulated among some of the most respected religious scholars in the Middle East and has been given widespread backing. It is being debated by politicians in the U.S. and studied by western intelligence agencies.<br />

Gallery: The new jihadi code In essence the new code for jihad is exactly what the West has been waiting for: a credible challenge from within jihadist ranks to al Qaeda's ideology.<br />
<br />
While the code states that jihad is permissible if Muslim lands are invaded -- citing the cases of Afghanistan, Iraq and Palestine -- the guidelines it sets down for when and how jihad should be fought, and its insistence that civilians should not be targeted are a clear rebuke to the goals and tactics of bin Laden's terrorist network.<br />
<br />
CNN was given exclusive access to the Abu Salim jail where the code was written to talk to the LIFG prisoners. The jail has a bloody reputation; in 1996 prison guards put down a revolt by allegedly killing more than 1,200 prisoners in less than 24 hours. Read how CNN got inside the prison<br />

We also had exclusive access to the story behind the new code from two of its principle architects.<br />
<br />
When Saif al Islam al Gadhafi, the son of Libyan leader Muammar Gaddafi, decided he wanted to open a dialogue with the LIFG he needed to convince them he was genuine so he sought out a former LIFG commander Noman Benotman, who was living in London.<br />
<br />
The younger Gadhafi convinced Benotman he would free LIFG members from jail if they renounced their long war with the regime. He promised Benotman immunity from prosecution and in January 2007 flew him back to Libya to meet with the LIFG leaders in the high-security Abu Salim jail.<br />
<br />
Benotman and the other leaders in the LIFG had fought together in Afghanistan in the early 1990s helping the Afghan Mujahedeen overthrow the Soviet-backed government in Kabul. During those years they'd come to know bin Laden and many other of al Qaeda leaders. <br />
<br />
Although they'd been brothers in arms with bin Laden, the LIFG never merged its operations with al Qaeda due to differences in approach. In particular the Libyan group never endorsed bin Laden's global jihad, preferring to concentrate their attention on overthrowing the Gadhafi regime and replacing it with an Islamic state. From the mid-1990s the Libyan Islamic Fighting Group's Afghan-trained fighters waged a fierce insurgency against the Libyan regime.<br />
<br />
In a face-to-face meeting in 2000 Benotman warned bin Laden not to attack the United States because any gains would be outweighed by the inevitable retribution, and undermine his group's efforts in Libya. By then Libyan security services had arrested many of the group's fighters in Libya.<br />
<br />
I questioned their [al Qaeda's] idea of Jihad directly you know. This is crazy, it is not Islamic. <br />
<br />

 Despite their differences bin Laden respected the LIFG's leadership. Indeed, according to Benotman, in the years before 9/11, bin Laden wanted to use the LIFG's extensive global network for his own ends but the group refused to put its assets at al Qaeda's disposal.<br />
<br />
When Benotman met with the LIFG leaders in January 2007 it was the first time they'd seen him in years. Some had been in jail for more than a decade. Others were captured in the international dragnet for jihadists thrown out by security services in the wake of 9/11. They agreed to consider Saif al Islam's proposal but had demands of their own.<br />
<br />
They wanted greater freedoms in jail, the right to consult with their rank and file membership, access to religious research books and more. Over time and many meetings the security officials granted most of their demands.<br />
<br />
Saif al Islam was motivated not just to bring a formal end to the civil war but to put a stop to al Qaeda's growing influence in Libya.<br />
<br />
As recently as 2006 al Qaeda documents captured by U.S. forces in Iraq showed per capita more Libyans than any other Arab nation were joining al Qaeda's fight. The regime's fear was that they'd bring their fight back to Libya.<br />
<br />
In late 2007 as Benotman, the LIFG leadership and Libya's security officials debated the way forward al Qaeda tried to derail the peace process. Bin Laden's deputy Ayman al Zawahiri issued a statement declaring the LIFG had joined al Qaeda.<br />
<br />
Benotman fired back an open letter to Zawahiri questioning his credibility. &quot;I questioned their idea of jihad ... directly you know. This is crazy, it is not Islamic and it's against the Sunni understanding of Islam,&quot; Benotman told CNN. Zawahiri chose not to respond. As late as this August Zawahiri's video statements included praise of LIFG leaders, in what may have been a desperate attempt to head off the condemnation he could see coming.<br />
<br />
Even so progress in the jail was slow. In April 2009 the talks were nearly derailed when Ibn Sheikh al Libi, a prominent jihadist was found hanged in his prison cell. According to sources familiar with the talks, Saif al Islam feared his death, which some LIFG members considered suspicious, could put the whole process in jeopardy. He put pressure on prison officials to meet the LIFG's remaining demands, giving them greater freedom to consult with the rank and file.<br />

That led the LIFG to start writing their Revisons. In July 2009 the peace process received a boost when 30 LIFG members living in the UK, some of them senior figures in the group, signed on. The group's UK members, some of whom were under British government Control Orders because they potentially posed a danger to UK national security, had previously been openly skeptical of the talks.<br />
<br />
In September the new code, the &quot;Corrective Studies&quot;, was completed, resulting in scores of lower and mid-level LIFG members being freed. Moammar Gadhafi's son says the group's leaders will be released at some point in the future, and will be encouraged to educate and dissuade Libya's youth from going off to fight with al Qaeda.<br />
<br />
According to Libyan sources, the British domestic intelligence agency MI5 passed on the Revisions document, after it was published, to a number of individuals subject to Control Orders in the UK. Those sources say the peace process led to Control Orders being dropped against 11 members of the group living in the UK, leaving only one Libyan subject to the restrictions. The process initiated in Tripoli appears to have directly made the West safer.<br />
<br />
In their new code for Jihadists, LIFG's leaders made it clear that battling extremism will be challenging. &quot;We have written this book knowing full well that the old motives and ideas which made us take up the armed struggle in the past are still to be found in the hearts and minds of many young Muslims today,&quot; they wrote.<br />
<br />
&quot;We know there are many issues that might lead them to take the same path; that's why we are offering our advice and guidance to these brothers.&quot;<br />
<br />
Given its credibility and the fact that several other prominent Jihadists in the Middle East have turned against al Qaeda, the LIFG's about face may be an important step toward staunching al Qaeda's recruitment.</div>

				Sacramento -- Just in time for the holidays, the State of California will once again dip into the wallets of taxpayers in California.<br />

As part of the budget deal negotiated last May, Californians will see an additional 10% in income tax withheld from their paychecks in November and December.<br />
<br />
“This is a real ‘bah humbug’ to California taxpayers, who are already overburdened this year,” said Jon Coupal, President of the Howard Jarvis Taxpayers Association. “This is precisely what we meant when we said the Legislature was kicking the can down the road. Now, at the height of the recession and with the highest unemployment rate in history, the state will gladly pick the pocket of millions of taxpayers this holiday season.”<br />
<br />
The change is due to the legislation (ABX4-17) passed by the Legislature and signed by the Governor to accelerate tax collection due to the State budget crisis. The “income shifting and tax acceleration provisions” require employers to increase by 10% the amount of income taxes withheld, based upon an employee’s current withholding designation.<br />
<br />
“The Legislature pretends this isn’t a ‘tax increase’ since it occurs six months later and it comes out of your paycheck in the dark of night,” said Coupal. “But to the millions who are struggling to keep their jobs and put food on the table, this smells like a tax, acts like a tax, and looks like a tax. It’s a tax.”<br />

I feel this model is necessary to avoid the poor from amassing large enough numbers to sway elections or important votes. Think of it this way... the lower 50% (assuming they paid 0 taxes, which isn't all true) could in turn rob the upper 50% blind. Sort of like what is beginning to happen already.<br />
<br />
So keeping that in mind, I propose that if you do not pay taxes (net federal or state liability) you should not get to vote.</div>

Its amazing to think that just 30 yrs. ago, racist elements of society were openly chastizing, brutalizing and murdering people because of the color of their skin; and now, the country is color blind enough to the point where color no longer matters (for the most part).<br />

There are, however, legacy of this country's racism that still exist today, and one of the greatest examples of that can be found in the classification of the ethnicity of our current president. I refer to none other than the &quot;One Drop Rule&quot;, left over from the days when Being black, or having any ounce of black blood , was considered a &quot;contagion&quot;, or a &quot;disease&quot;.<br />

In essence, stating that if you were &quot;tainted&quot; with black blood, even by the smallest margin, you were not &quot;pure&quot; anymore, and were still to be considered black, by courts and legal documents.<br />
<br />

Fast forward to today, where our president, Barack Obama, is a MULATTO, meaning, a mix between black and white.<br />

In fact, I think increased competition would probably lower their rates further...which is what I'd like to see.  <br />

I also don't believe the govt can offer a more competitive option...or find ways to lower costs...unless that means allowing more insurance companies to compete across state lines.  <br />

Also, I understand the argument that insurance companies should not profit for insuring our health...as there are moral and ethical arguments that can be made.<br />

				WASHINGTON (AP) - Quick quiz: What do these enterprises have in common? Farm and construction machinery, Tupperware, the railroads, Hershey sweets, Yum food brands and Yahoo? Answer: They're all more profitable than the health insurance industry. In the health care debate, Democrats and their allies have gone after insurance companies as rapacious profiteers making &quot;immoral&quot; and &quot;obscene&quot; returns while &quot;the bodies pile up.&quot;<br />
Ledgers tell a different reality. Health insurance profit margins typically run about 6 percent, give or take a point or two. That's anemic compared with other forms of insurance and a broad array of industries, even some beleaguered ones.<br />
Profits barely exceeded 2 percent of revenues in the latest annual measure. This partly explains why the credit ratings of some of the largest insurers were downgraded to negative from stable heading into this year, as investors were warned of a stagnant if not shrinking market for private plans.<br />
Insurers are an expedient target for leaders who want a government-run plan in the marketplace. Such a public option would force private insurers to trim profits and restrain premiums to compete, the argument goes. This would &quot;keep insurance companies honest,&quot; says President Barack Obama.<br />
The debate is loaded with intimations that insurers are less than straight, when they are not flatly accused of malfeasance.<br />
They may not have helped their case by commissioning a report that looked primarily at the elements of health care legislation that might drive consumer costs up while ignoring elements aimed at bringing costs down. Few in the debate seem interested in a true balance sheet.<br />
But in pillorying insurers over profits, the critics are on shaky ground. A look at some claims, and the numbers:<br />
THE CLAIMS<br />
_&quot;I'm very pleased that (Democratic leaders) will be talking, too, about the immoral profits being made by the insurance industry and how those profits have increased in the Bush years.&quot; House Speaker Nancy Pelosi, D-Calif., who also welcomed the attention being drawn to insurers'&quot;obscene profits.&quot;<br />
_&quot;Keeping the status quo may be what the insurance industry wants their premiums have more than doubled in the last decade and their profits have skyrocketed.&quot; Maryland Rep. Chris Van Hollen, member of the Democratic leadership.<br />
_&quot;Health insurance companies are willing to let the bodies pile up as long as their profits are safe.&quot; A MoveOn.org ad.<br />
THE NUMBERS:<br />
Health insurers posted a 2.2 percent profit margin last year, placing them 35th on the Fortune 500 list of top industries. As is typical, other health sectors did much better - drugs and medical products and services were both in the top 10.<br />
The railroads brought in a 12.6 percent profit margin. Leading the list: network and other communications equipment, at 20.4 percent.<br />
HealthSpring, the best performer in the health insurance industry, posted 5.4 percent. That's a less profitable margin than was achieved by the makers of Tupperware, Clorox bleach and Molson and Coors beers.<br />
The star among the health insurance companies did, however, nose out Jack in the Box restaurants, which only achieved a 4 percent margin.<br />
UnitedHealth Group, reporting third quarter results last week, saw fortunes improve. It managed a 5 percent profit margin on an 8 percent growth in revenue.<br />
Van Hollen is right that premiums have more than doubled in a decade, according to a Kaiser Family Foundation study that found a 131 percent increase.<br />
But were the Bush years golden ones for health insurers?<br />
Not judging by profit margins, profit growth or returns to shareholders. The industry's overall profits grew only 8.8 percent from 2003 to 2008, and its margins year to year, from 2005 forward, never cracked 8 percent.<br />
The latest annual profit margins of a selection of products, services and industries: Tupperware Brands, 7.5 percent; Yahoo, 5.9 percent; Hershey, 6.1 percent; Clorox, 8.7 percent; Molson Coors Brewing, 8.1 percent; construction and farm machinery, 5 percent; Yum Brands (think KFC, Pizza Hut, Taco Bell), 8.5 percent.
